This section sets forth congressional findings concerning the U.S. District Court for the Eastern District of California, including that it serves 34 counties and approximately 8.4 million people across 87,000 square miles with only six permanent judgeships (one upcoming vacancy pending); has the highest ratio of population per authorized judgeship in California at 1:1,362,552 (compared to 1:694,323 in the Central District); and maintains a pending caseload of 1,308 cases per judgeship as of June 2022—over 2.6 times the average in the Ninth Circuit.
This section directs the President to appoint, by and with the advice and consent of the Senate, additional district judges for the Eastern District of California—2 on or after January 21, 2027; 1 on or after January 5, 2029; and 2 on or after January 21, 2031—and revises the statutory table of authorized district judgeships for California districts (28 U.S.C. §133(a)) in three phases: (1) effective January 20, 2027, Northern District to 14 (from 6), Eastern District to 8 (from 6), Central District to 27 (from 28), and Southern District to 13 (unchanged); (2) effective January 4, 2029, Eastern District to 9 (from 8); and (3) effective January 20, 2031, Eastern District to 11 (from 9).
This section authorizes appropriations of such sums as necessary to carry out this Act and its amendments, including for space and facilities for judicial positions created by the Act.
