H.R. 1867 — To amend title XVIII of the Social Security Act to remove in-person requirements under Medicare for mental health services furnished through telehealth and telecommunications technology.

This section revises Medicare telehealth payment requirements under section 1834(m)(7) to waive geographic restrictions for substance use disorder services furnished on or after July 1, 2020, and for mental health diagnosis, evaluation, or treatment furnished on or after the day after the end of the COVID-19 public health emergency (as defined in section 1135(g)(1)(B)), when provided at an eligible originating site (other than a hospital) or, during applicable temporary periods, at a patient's home. (As background, Medicare Part B telehealth services generally require the beneficiary to be physically present at a qualifying rural originating site.) It also permanently extends mental health telehealth services furnished by rural health clinics (previously allowed prior to April 1, 2025) and by federally qualified health centers (previously allowed prior to April 1, 2025).
