H.R. 188 — Amtrak Transparency and Accountability for Passengers and Taxpayers Act

This section revises the application of the Freedom of Information Act (5 U.S.C. §552) and open meetings requirements under the Government in the Sunshine Act (5 U.S.C. §552b) to Amtrak (i.e., the National Railroad Passenger Corporation) by structuring the provision into paragraphs that—(1) specify general application except as provided; (2) address timing of application; (3) exempt from public notice requirements (second sentence of §552b(b)) and records and transcript requirements (§552b(d)-(e)) any Amtrak meeting portions or related information that the corporation determines likely involve contract negotiations imperiling its competitive position, collective bargaining, individual employment or personnel matters (unless the affected individual requests public discussion), or confidential commercial information—while also applying standard exemptions (§552b(c)); and (4) clarify that the provision does not require disclosures risking safety or prevent legal compliance, contract performance, or Amtrak's statutory business activities.
