H.R. 1938 — Department of Defense PFAS Discharge Prevention Act

This section requires the Secretary of Defense, not later than one year after the date of enactment, to request from the relevant state or the EPA, for each Clean Water Act (CWA) section 402(p) stormwater permit (33 U.S.C. 1342(p)) applicable to a Department of Defense (DoD) facility, a permit modification or revision to the facility's stormwater management plan that includes (1) monitoring of per- and polyfluoroalkyl substance (PFAS) discharges not less frequently than quarterly and (2) best management practices or control technologies to reduce such discharges consistent with CWA requirements. This section further requires that, of funds authorized to be appropriated by this Act or otherwise made available annually to the Secretary for PFAS remediation efforts, not less than 1% be obligated or expended each fiscal year for PFAS testing in stormwater runoff at DoD facilities.
