H.R. 1950 — Protect Social Security and Medicare Act

This section establishes a supermajority vote requirement—two-thirds of Members present and voting—for the House of Representatives or Senate to consider any bill, joint resolution, or amendment that reduces an existing benefit provided or administered by the Social Security Administration (SSA) or Centers for Medicare & Medicaid Services (CMS). Subsection (b) excepts reductions in payments to Medicare Advantage plans under Medicare Part C if accompanied by an equal or greater increase in payments for other Medicare purposes under Title XVIII of the Social Security Act.

This section requires that any determination, during House or Senate consideration of a bill, joint resolution, or amendment, as to whether a provision would result in a reduction of Social Security benefits as described in section 2(a) or a reduction or increase as described in section 2(b), be made solely on the basis of a determination by the Office of the Chief Actuary of the Social Security Administration.
