H.R. 1995 — Securing American Agriculture Act

This section directs the Secretary of Agriculture to submit an annual assessment to the House Committee on Agriculture and the Senate Committee on Agriculture, Nutrition, and Forestry on U.S. dependency on critical agricultural inputs (i.e., farm management, agronomic, and field-applied production inputs, including agricultural equipment and machinery, fuel, fertilizers, feed and components such as vitamins and amino acids, veterinary drugs and vaccines, crop protection chemicals, seed, and others determined by the Secretary) that could be exploited if China weaponizes such dependencies. The assessment must address, for each critical input, (1) current domestic production capacity, (2) current and potential supply chain bottlenecks exploitable by China, and (3) recommendations to reduce U.S. dependency on China, including mitigation of supply chain threats and legislative or regulatory actions to onshore or nearshore production. Information collection is voluntary from private entities and must be used only for aggregate data in the assessment, with no disclosure of trade secrets or confidential information under 5 U.S.C. §552(b)(4) or 18 U.S.C. §1905 (i.e., the Trade Secrets Act, which prohibits unauthorized disclosure of confidential business information by federal officers). (Thus, provided information receives immunity from any other use by the Secretary.)
