H.R. 2005 — DMEPOS Relief Act of 2025

This section directs the Secretary of Health and Human Services to (1) apply the transition rule under 42 CFR 414.210(g)(9)(v) (or successor regulation)—which maintains blended payment rates for durable medical equipment, prosthetics, orthotics, and supplies (DMEPOS) in non-competitive bidding areas—to items and services furnished in areas other than rural or noncontiguous areas through December 31, 2025; and (2) delay implementation of 42 CFR 414.210(g)(9)(vi) (or successor regulation)—which establishes adjusted payment rates matching competitive bidding areas—in all such areas until January 1, 2026. (As background, Medicare's DMEPOS competitive bidding program sets payment rates for certain items, such as oxygen equipment and power mobility devices, based on supplier bids in competitive bidding areas; non-competitive bidding areas use transition rules to phase in equivalent adjusted rates.)
