H.R. 2007 — Salary Transparency Act

This section adds a new section 8 to the Fair Labor Standards Act (FLSA) prohibiting employers from (1) failing to disclose the wage or wage range in any public or internal job posting; (2) failing to disclose the wage or wage range to an applicant prior to discussing compensation or upon request if no posting was made; (3) failing to disclose the wage or wage range to an employee upon hire, annually thereafter, or upon request; or (4) retaliating against employees or applicants for exercising these rights. It defines "wage range" for an employment opportunity as the range of wages, salaries, or other compensation the employer anticipates in good faith using to set pay, which may reference applicable pay scales, prior ranges, incumbent wages, or budgeted amounts. This section further amends FLSA section 16 (29 U.S.C. 216) by adding subsection (f), which imposes on violators of section 8 (1) a civil penalty of $5,000 for a first violation, increased by $1,000 for each subsequent violation not to exceed $10,000; and (2) liability to each affected employee or applicant for statutory damages of $1,000 to $10,000 or actual damages (whichever greater), reasonable attorneys' fees, and appropriate injunctive relief, with such actions maintainable collectively in federal or state court.
