H.R. 2027 — Returning SBA to Main Street Act of 2025

This section defines terms for purposes of the Act, including (1) Administration and Administrator, meaning the Small Business Administration and its Administrator, respectively; (2) budget justification materials, employee, pay locality, telework, headquarters of the Administration (i.e., its principal managerial and administrative center per 15 U.S.C. 633(a)), and other personnel-related terms per specified provisions of title 5, U.S. Code; (3) headquarters employee of the Administration, meaning an employee with a permanent duty station at headquarters or a full-time teleworker paid at Washington metropolitan area rates; (4) rural, meaning any non-urban area per the most recent Census Bureau data; and (5) telework on a full-time basis, meaning authorization to telework 100% of work days per pay period.

This section requires the Administrator of the Small Business Administration (SBA), if determined to reduce federal costs (as detailed in a required report), to relocate the permanent duty station of at least 30% of headquarters employees as of enactment to SBA regional offices outside the Washington metropolitan area within one year of enactment, with pay based on the new locality rate and no full-time telework authorization. (1) New duty stations must promote geographic diversity (including rural areas) and adequate regional staffing for in-person customer service; (2) all headquarters employees are eligible except those with Americans with Disabilities Act accommodations for full-time telework (who count toward the 30% threshold); and (3) full-time teleworkers remaining in the Washington area lose that authorization 180 days after the report. Within 180 days of enactment, the Administrator must report to the Senate Committee on Small Business and Entrepreneurship and House Committee on Small Business the number of headquarters employees, those eligible and to be relocated, exceptions, and implementation plan; relocations occur 150-180 days after the report via employee notice, with no relocation incentives if an employee's official worksite shifts from residence to headquarters.

This section directs the Administrator to reduce the headquarters office space of the Administration by at least 30 percent, beginning no later than 180 days after the date of enactment of this Act and completing the reduction no later than two years after such date.

This section directs the Administrator of the Small Business Administration to include in the first budget justification materials submitted to Congress after enactment of this Act, and in those materials for each fiscal year thereafter, (1) the number of headquarters employees; (2) the number of employees assigned to a permanent duty station in a field, district, or regional office; (3) the number of full-time teleworking employees; and (4) the number of employees receiving a full-time telework accommodation as a qualified individual under title I of the Americans with Disabilities Act of 1990.

This section establishes a severability clause, providing that if any provision of the Act, or its application to any person or circumstance, is held unconstitutional, the remainder of the Act and the application of the provision to other persons or circumstances remains unaffected.
