H.R. 205 — No Congressional Funds for Sanctuary Cities Act

This section prohibits the use of federal funds for any congressional earmark targeted to a state or unit of local government that is a sanctuary jurisdiction. The term congressional earmark has the meaning given under House Rule XXI, cl. 9(e) (i.e., a provision or report language directing funds for a specific project, activity, or entity).

This section defines a "sanctuary jurisdiction" for purposes of this Act as any state or political subdivision with a statute, ordinance, policy, or practice that prohibits or restricts any government entity or official from (1) sending, receiving, maintaining, or exchanging information regarding an individual's citizenship or immigration status with federal, state, or local government entities; or (2) complying with a Department of Homeland Security (DHS) request under Immigration and Nationality Act (INA) sections 236 or 287 (8 U.S.C. 1226, 1357)—governing alien detention pending removal decisions and immigration officer powers, respectively—for a detainer or release notification regarding an individual. It excepts from this definition a jurisdiction based solely on a policy of not sharing such information or complying with a DHS detainer request for an individual who comes forward as a victim or witness to a criminal offense.
