H.R. 2060 — Traveler’s Gun Rights Act

This section revises the definition of "state of residence" in 18 U.S.C. §921(a) by striking subsection (b)—which previously defined it simply as the state in which an individual resides—and adding new paragraphs (38) and (39) to specify that it means (A) the state in which an individual resides (i.e., present with intent to make a home, including multiple states of residency when present there); (B) for active duty Armed Forces members or their spouses, the state of the member's permanent duty station or the state from which the member commutes daily; or (C) for individuals without a physical residence in any state, the state of their private mailbox or post office box. This section further amends the National Instant Criminal Background Check System (NICS) requirements under 18 U.S.C. §922(t)(1)(D) to require that ATF Form 4473—which prospective firearm transferees must complete—include the transferee's residence address or, if none, the address of a private mailbox or post office box. (Thus, these changes clarify residency for federal firearms licensing, transfers, and prohibitions, particularly benefiting military personnel and expanding options for those without fixed addresses.)
