H.R. 2070 — Protect Our Military Families’ 2nd Amendment Rights Act

This section expands an existing exception under 18 U.S.C. § 925(a)(3) to permit licensed importers, manufacturers, and dealers to sell or deliver firearms and ammunition to the spouse of a member of the Armed Forces stationed at a duty station outside the United States. (The exception previously applied only to such members.)

This section revises the definition of residency for purposes of federal firearms laws to explicitly include spouses of Armed Forces members on active duty, determining residency for both on the same basis: (1) the state in which the member or spouse maintains legal residence; (2) the state in which the member's permanent duty station is located; and (3) the state in which the member maintains a place of abode from which the member commutes daily to the permanent duty station. (Thus, this facilitates firearms purchases by military spouses in states tied to the service member's duty without needing to establish separate residency.)
