This section expands the criteria under which the Attorney General may certify an alien for mandatory detention as a terrorist alien by adding as a ground presence on the terrorist screening database (i.e., the U.S. government's consolidated terrorist watchlist, as defined in the Homeland Security Act of 2002). It further requires the Commissioner of U.S. Customs and Border Protection to take into custody and maintain custody of any alien until the alien's name is cross-referenced with the terrorist screening database and a result is received. (As background, INA §236A generally mandates detention without bond or supervised release for aliens certified as engaging in terrorist or national security-related activity, irrespective of eligibility for relief from removal, subject to limited exceptions including time-limited proceedings and periodic review.)
