H.R. 2102 — Major Richard Star Act

This section authorizes members retired under chapter 61 of title 10, U.S. Code (i.e., medical disability retirees), who are entitled to veterans' disability compensation for a combat-related disability (as defined in 10 U.S.C. §1413a(e)) to receive both retired pay and such compensation for any month without offset under 38 U.S.C. §§5304-5305. (Thus, such retirees—previously subject to partial or no concurrent receipt based on service length—may now receive full concurrent payments regardless of years of service.) It also clarifies that retired pay of Combat-Related Special Compensation (CRSC) recipients is not subject to such offsets. The section further removes obsolete phase-in provisions for general concurrent receipt (ended December 31, 2013), redesignates subsections, updates the section heading and table of sections for 10 U.S.C. §1414, and makes conforming amendments. Amendments apply to payments for months beginning on the first day of the first month after enactment.
