H.R. 2105 — Preventing Illegal Weapons Trafficking Act of 2025

This section establishes definitions for this Act, including (1) "machinegun," which has the meaning given "machine gun" in section 5845 of the Internal Revenue Code of 1986 (i.e., any weapon that shoots more than one shot without manual reloading by a single function of the trigger), and (2) "machinegun conversion device," meaning any part or combination of parts designed and intended solely and exclusively for use in converting a weapon into a machinegun.

This section directs the Attorney General, the Secretary of Homeland Security, and the Secretary of the Treasury to develop and implement, not later than 120 days after the date of enactment, a strategy to prevent or intercept the importation or trafficking of machinegun conversion devices (i.e., devices that enable semiautomatic firearms to function as machineguns). The strategy must include plans to optimize (1) the detection, interception, and seizure capacity of federal law enforcement agencies; (2) coordination between state and local law enforcement and specified federal agencies (Bureau of Alcohol, Tobacco, Firearms, and Explosives, Federal Bureau of Investigation, Homeland Security Investigations, and U.S. Customs and Border Protection) on seizures at ports of entry; (3) Bureau of Alcohol, Tobacco, Firearms, and Explosives collaboration with state and local agencies to identify and trace devices used in crimes, including their sources; (4) federal training programs for state and local agencies on identifying such devices; (5) investigation and data collection on the origins of seized devices to identify patterns and vulnerabilities; and (6) federal capacity to detect, intercept, and seize domestically produced devices, including those made with 3D printing. This section further requires those officials to submit to the Senate and House Committees on the Judiciary and Homeland Security (Senate Committee on Homeland Security and Governmental Affairs) an initial report on the strategy, including relevant statistical information, not later than 120 days after enactment, with updates at least every two years thereafter describing implementation progress.

This section expands the forfeiture provisions of IRC §5872(a)—previously applicable to firearms and property involved in or used to commit National Firearms Act (NFA) violations—to also include any proceeds derived from the illegal trafficking of a machine gun. It defines illegal trafficking of a machine gun as the making, manufacture, importation, exportation, or transfer of a machine gun in violation of the NFA (i.e., chapter 53 of the IRC) or regulations thereunder. (Thus, the government may seize profits from such trafficking in addition to the weapons themselves.)

This section directs the Attorney General to include in the annual firearms trafficking report—announced by the President on April 7, 2021—information on machinegun conversion devices, specifically (1) the number of crimes in which such devices are used and (2) whether devices recovered from those crimes are manufactured in the United States or a foreign country.
