H.R. 2114 — Block Organ Transplant Purchases from China Act of 2025

This section excludes from Medicare coverage under parts A and B, effective January 1, 2026, any prohibited organ transplant (as defined in new section 402(d) of the National Organ Transplant Act) or any related item or service (e.g., follow-up appointment, laboratory test, or drug) furnished on or after that date, unless the item or service is to save the recipient's life post-transplant. A prohibited organ transplant is the transplantation of a specified human organ (i.e., kidney, liver, heart, lung, pancreas, bone marrow, cornea, eye, bone, or intestine) that occurs in the People's Republic of China or uses an organ not procured through the Organ Procurement and Transplantation Network. This section similarly prohibits Medicaid payment for such transplants and related items or services furnished on or after January 1, 2026 (with the same life-saving exception), including under managed care entities. This section prohibits group health plans and health insurance issuers offering group or individual coverage from covering such transplants and related items or services (with the same life-saving exception), effective for plan years beginning on or after January 1, 2026. This section further establishes a nationwide prohibition, effective January 1, 2026, barring health care providers from furnishing such transplants or related items or services (with the same life-saving exception) and imposes penalties for knowing violations: (1) criminal penalties of a fine, imprisonment for up to two years, or both; and (2) civil penalties of three times the cost of the transplant or item or service, as enforced by the Attorney General or state attorneys general.
