H.R. 2115 — Ending China’s Unfair Advantage Act of 2025

This section prohibits the obligation or expenditure of federal funds to implement the Montreal Protocol on Substances that Deplete the Ozone Layer—including its protocols, amendments, or any associated fund—until the President certifies to the appropriate congressional committees that the Protocol's Parties have amended Decision I/12E to remove the People's Republic of China as a developing country. (As background, the Montreal Protocol is the primary international agreement to phase out production and consumption of ozone-depleting substances; Decision I/12E classifies certain countries, including China, as developing for purposes of differentiated obligations and access to financial assistance.)

This section prohibits the obligation or expenditure of federal funds for the operations and meetings of the United Nations Framework Convention on Climate Change (UNFCCC), including its protocols or agreements or any fund established under the Convention or its agreements, until the President certifies to the appropriate congressional committees that the Parties to the Framework Convention have included the People's Republic of China in Annex I of the Convention (i.e., the list of developed country parties subject to binding greenhouse gas emission limitation and reduction commitments).

This section defines key terms for purposes of the Act, including (1) appropriate congressional committees as the Senate Committees on Foreign Relations and Appropriations and the House Committees on Foreign Affairs and Appropriations; (2) Montreal Protocol as the Montreal Protocol on Substances that Deplete the Ozone Layer, done at Montreal on September 16, 1987; and (3) United Nations Framework Convention on Climate Change as the convention adopted in Rio de Janeiro, Brazil, in June 1992.
