H.R. 2124 — LAND Act

This section restricts sales of agricultural land to foreign purchasers—defined as foreign persons under the Agricultural Foreign Investment Disclosure Act of 1978 (AFIDA; 7 U.S.C. 3508) or U.S. citizens who are citizens of another country—by subjecting them to (1) the same restrictions applicable to U.S. citizens buying agricultural land in the foreign purchaser's home country (determined by the U.S. Land Protection Task Force based on citizenship or ownership thresholds, selecting the most restrictive country where applicable) and (2) applicable state laws. This section requires sellers to notify the Secretary of Agriculture of such sales, with the Secretary notifying the state's senators and the relevant House member. (Thus, AFIDA's existing disclosure requirements for foreign-held agricultural land are supplemented by reciprocity-based purchase limits and targeted congressional alerts.) This section establishes the U.S. Land Protection Task Force—chaired by the Secretary of Agriculture and comprising the Committee on Foreign Investment in the United States, the National Security Division of the Department of Justice, and the Secretary of State—to identify violations and submit semiannual reports to Congress (beginning one year after enactment) detailing foreign agricultural land purchases by land type percentage, state, average cost, title history, and proximity to military installations within 100 miles. This section includes a severability clause.
