H.R. 2127 — Expel Illegal Chinese Police Act of 2025

This section requires the President, on and after enactment, to impose property-blocking sanctions under the International Emergency Economic Powers Act (IEEPA, 50 U.S.C. 1701 et seq.)—exercising all powers under IEEPA §§203 and 205 (50 U.S.C. 1702, 1704)—on foreign persons determined to be (1) a provincial, municipal, or other jurisdictional police department or law enforcement institution in the People's Republic of China (PRC), including those in Xinjiang Uyghur Autonomous Region and Fujian; (2) a senior leader of such a department or institution; (3) directly associated with establishing or maintaining a Chinese police presence in the United States; (4) acting under the direction of a PRC Public Security Bureau or law enforcement institution; or (5) acting under the direction of the United Front Work Department (UFWD) to covertly monitor or intimidate U.S. residents. (IEEPA authorizes the President to block all property and interests in property of designated foreign persons within U.S. jurisdiction or in the possession of U.S. persons during a declared national emergency; violations are subject to IEEPA civil and criminal penalties under 50 U.S.C. 1705(b)-(c).) The section further renders inadmissible to the United States—and ineligible for visas, admission, parole, or other Immigration and Nationality Act benefits—any alien determined to be (1) an employee of a department described above or a person described in category (5); (2) an immediate family member (spouse, parent, sibling, or adult child) of such an employee; or (3) directly associated with establishing or maintaining a Chinese police or UFWD presence in the United States, with any existing visas or entry documents revoked immediately and automatically canceling other valid documentation. This section authorizes the President to waive sanctions on a case-by-case basis for periods not exceeding 30 days upon certifying to Congress at least 15 days prior that the waiver is vital to U.S. national security interests (potentially in classified form). It also directs federal agencies to refrain from participating in any non-U.S. government-initiated investigation of covered foreign persons unless the President determines such participation is vital to the health, safety, and well-being of U.S. citizens.
