H.R. 2159 — Count the Crimes to Cut Act

This section defines "criminal regulatory offense" (i.e., a federal regulation enforceable by criminal penalty) and "criminal statutory offense" (i.e., a criminal offense under federal statute) and directs the Attorney General to submit to the Senate and House Judiciary Committees, not later than one year after enactment, a report listing all federal criminal statutory offenses—including their elements, potential penalties, mens rea requirements, and Department of Justice prosecutions over the preceding 15 years—and to establish a publicly accessible index of those offenses on the Department of Justice website not later than two years after enactment. The section further directs the heads of 34 specified federal agencies (e.g., Departments of Agriculture, Commerce, Health and Human Services, and Treasury; Environmental Protection Agency; Securities and Exchange Commission) to submit similar reports on their criminal regulatory offenses—including potential penalties, referrals to the Department of Justice for prosecution over the preceding 15 years, and mens rea requirements—and to establish publicly accessible indexes on their agency websites not later than two years after enactment. Nothing in the section requires or authorizes appropriations.
