H.R. 2171 — Spectrum Coordination Act

This section establishes federal coordination procedures between the NTIA Assistant Secretary and the FCC for spectrum actions (i.e., proposed reallocations of radio frequency spectrum for competitive bidding under 47 U.S.C. 309(j) or licensing potentially impacting federal spectrum operations). Specifically, it (1) requires the Assistant Secretary to file in the public record, by the end of the FCC comment period, specified information on notices provided under the FCC-NTIA Memorandum of Understanding, impacted federal entities, and any technical, procedural, or policy concerns (redacted as necessary for classified or exempt information); (2) requires the FCC to publish in the Federal Register with any final rule on a spectrum action an interagency coordination summary describing such notices, raised concerns, and resolutions; and (3) requires the FCC and NTIA to update their August 1, 2022, Memorandum of Understanding (or successor) no later than 3 years after enactment and every 4 years thereafter to reflect changing technological, procedural, and policy circumstances. (Thus, these requirements enhance public transparency into interagency spectrum coordination without mandating disclosure of protected information.)
