H.R. 2197 — No 340B Savings for Transgender Care Act

This section prohibits covered entities participating in the 340B Drug Pricing Program (i.e., the program under Section 340B of the Public Health Service Act that requires manufacturers to sell covered outpatient drugs to eligible entities such as safety-net hospitals and clinics at discounted ceiling prices) from using savings derived from the difference between the 340B ceiling price and actual acquisition cost to pay for (1) sex reassignment surgeries furnished for the purpose of gender alteration of a transgender individual or (2) hormone treatments furnished for such purpose.
