H.R. 220 — Veterans Infertility Treatment Act of 2025

This section establishes authority under new 38 U.S.C. §1720K for the Department of Veterans Affairs (VA) to furnish infertility treatments (including assisted reproductive technology such as in vitro fertilization), standard fertility preservation services (i.e., procurement, cryopreservation, and storage of gametes and embryos), or both, to covered individuals—defined as enrolled veterans who have infertility or are at risk thereof (as determined by a licensed physician) or partners selected by such veterans—at the individual's election and subject to specified consents. For in vitro fertilization, VA may furnish not more than three completed cycles that result in live birth or 10 attempted cycles, whichever occurs first, and may use donated gametes or embryos. The section deems partners of covered veterans eligible for beneficiary travel payments under 38 U.S.C. §111; governs the legal status of gametes and embryos under state law; and clarifies that it does not require maternity care beyond existing requirements under 38 U.S.C. §1786. VA must prescribe implementing regulations not later than one year after enactment, with the new authority applying upon issuance of such regulations; beginning 180 days after enactment, VA must expand counseling and treatment under its existing infertility authority to unmarried partners and donated gametes or embryos, with continuity options for ongoing recipients.
