H.R. 2219 — Salary History Question Prohibition Act

This section amends the Fair Labor Standards Act (FLSA) to prohibit employers from (1) relying on a prospective employee's wage history when considering the employee for employment or determining the employee's wages, (2) seeking the prospective employee's wage history from the employee or prior employers, or (3) retaliating against any employee or prospective employee who opposes such practices (with exceptions allowing an employer to rely on or confirm wage history voluntarily provided by the prospective employee after a compensation offer, to support a higher wage). It further establishes penalties for violations, including civil penalties of $5,000 for a first offense (increased by $1,000 for each subsequent offense, not to exceed $10,000) and liability to each affected employee or prospective employee for special damages up to $10,000, attorneys' fees, and injunctive relief through collective actions in federal or state court.
