H.R. 2240 — Improving Law Enforcement Officer Safety and Wellness Through Data Act

This section states congressional findings on the rise in anti-police rhetoric and violence against law enforcement officers—including 60 felonious killings in 2022, with nearly 30% from unprovoked attacks or ambushes—the need for expanded data collection on such incidents as part of the Uniform Crime Reports (34 U.S.C. 41303), officer mental health challenges, and Congress's commitment to supporting law enforcement.

This section requires the Attorney General, in consultation with the FBI Director, National Institute of Justice Director, and FBI Criminal Justice Information Services Division Director, to submit a report to the Senate and House Judiciary Committees not later than 270 days after enactment of this Act on attacks targeting law enforcement officers. The report must include (1) the number of offenders intentionally targeting law enforcement officers due to their status; (2) the number of Law Enforcement Officers Killed and Assaulted (LEOKA) incidents involving coordinated actions by two or more parties; (3) the federal response to ambushes and violent attacks on federal law enforcement officers; (4) state and local responses to such attacks on their officers; (5) recommendations to improve state, local, and federal responses; (6) a survey of federal and state training programs preparing officers for violent and ambush attacks; (7) an analysis of those programs' effectiveness; (8) recommendations to improve such training; (9) an analysis of the Patrick Leahy Bulletproof Vest Partnership (34 U.S.C. 10530 et seq.)—which provides matching grants to purchase body armor for law enforcement—including its efficacy, location-specific limitations, and general limitations amid ambush attacks; (10) an analysis of combining LEOKA data with 09C Justifiable Homicide reports for officer-involved shootings; (11) an analysis of expanding FBI Criminal Justice Information Services data collection to include suspect injury levels in LEOKA incidents; (12) an analysis of disparities in data availability and reporting between ambush attacks on officers and other violent crimes; and (13) an analysis of additional legislative tools to deter such ambushes. In developing the report, these officials must consult federal, state, tribal, and local law enforcement agencies and nongovernmental organizations, academies, or other entities.

This section directs the Attorney General, in consultation with the Director of the Federal Bureau of Investigation and the Director of the National Institute of Justice, to submit to the Senate and House Judiciary Committees, not later than 270 days after enactment, a report that includes (1) an analysis of implementing a new category in the Uniform Crime Reporting System and National Incident-Based Reporting System for aggressive actions, conduct, or other trauma-inducing incidents against law enforcement officers not currently reported; (2) the level of detail and standard of evidence for that category; (3) strategies to engage state and local law enforcement agencies in reporting such data beyond standard crime reporting; (4) potential uses of the data by the Department of Justice and its components; (5) disparities in availability and reporting between non-criminal aggressive actions against officers and other violent crime data, including reasons for those disparities; and (6) additional legislative tools to deter such incidents. In developing the report, these officials must consult federal, state, tribal, and local law enforcement agencies as well as nongovernmental organizations, international organizations, academies, and other entities.

This section directs the Attorney General, in consultation with the Director of the Federal Bureau of Investigation and the Director of the National Institute of Justice, to submit a report to the Senate and House Judiciary Committees not later than 270 days after enactment on (1) types, frequency, and severity of mental health and stress-related responses of law enforcement officers to aggressive actions or other trauma-inducing incidents; (2) available mental health and stress-related resources or programs for such officers at the federal, state, and local levels, especially peer-to-peer programs; (3) the extent to which officers use those resources; (4) the availability of, or need for, mental health screening within federal, state, and local law enforcement agencies; and (5) additional legislative tools or authorities to assist in assessing, monitoring, and improving officers' mental health and wellness. In developing the report, these officials must consult relevant stakeholders, including federal, state, tribal, and local law enforcement agencies; and nongovernmental organizations, international organizations, academies, or other entities.
