H.R. 2276 — CRT Act

This section prohibits (1) allocation of federal funds received by a state or local educational agency to an elementary or secondary school that promotes specified race-based theories or compels teachers or students to affirm, adhere to, adopt, or profess beliefs violating Title VI of the Civil Rights Act of 1964, and (2) award of any federal funds to an institution of higher education that does the same. The prohibited theories are that (1) any race is inherently superior or inferior to another race, color, or national origin; (2) the United States is fundamentally racist; (3) the Declaration of Independence or Constitution are fundamentally racist; (4) an individual's moral character is determined by race, color, or national origin; (5) an individual is inherently racist or oppressive by virtue of race; or (6) an individual bears responsibility for actions of others of the same race, color, or national origin. It includes rules of construction clarifying that the prohibition does not restrict protected speech outside school settings, access to materials for research, or contextual education that disavows such theories; and defines "covered school," "promote" (i.e., including curricula endorsement, hiring advocates, compelling belief, or race-based segregation), and other terms (incorporating statutory definitions of "institution of higher education" under the Higher Education Act of 1965).
