H.R. 2346 — Accountability for Terrorist Perpetrators of October 7th Act

This section requires the President, on and after 90 days after enactment, to impose sanctions under the International Emergency Economic Powers Act (IEEPA, 50 U.S.C. 1701 et seq.) on the Popular Resistance Committees (PRC), a Gaza-based terrorist organization; its officials, agents, and affiliates; entities owned or controlled by them; and any armed organizations operating under the PRC umbrella. The sanctions include (1) blocking all property and interests in property of sanctioned persons that are in the United States, come within the United States, or are in the possession or control of U.S. persons; and (2) rendering such persons inadmissible to the United States, ineligible for visas or parole, and subject to revocation of any current visas. Exceptions apply for compliance with U.N. Headquarters Agreement obligations and U.S. intelligence, law enforcement, or national security activities; IEEPA civil and criminal penalties apply to violations; the President may use specified IEEPA implementation authorities; and the President may waive sanctions for one or more 180-day periods upon certification to congressional committees.

This section requires the Secretary of State to submit to the appropriate congressional committees (1) within 90 days of enactment, a report assessing whether Lion’s Den meets the criteria for designation as a specially designated global terrorist (SDGT) under E.O. 13224 or as a foreign terrorist organization (FTO) under 8 U.S.C. 1189 and whether the Popular Resistance Committees meets SDGT criteria under E.O. 13224, including detailed justifications if any determination is negative; and (2) not later than one year after enactment and every two years thereafter, reports identifying new entities operating under the umbrella of the Popular Resistance Committees or any successors and determining whether each meets SDGT or FTO criteria under E.O. 13224 or 8 U.S.C. 1189, respectively, or sanctions criteria under section 2 of this Act, including detailed justifications if any determination is negative. The initial report must be unclassified but may include a classified annex. (As background, FTO designation under 8 U.S.C. 1189 subjects organizations to material support prohibitions, immigration restrictions, and asset blocking, while SDGT designation under E.O. 13224 blocks U.S. assets and prohibits transactions.)

This section defines the term “appropriate committees of Congress” to mean (1) the Senate Committee on Foreign Relations and the Senate Committee on the Judiciary; and (2) the House Committee on Foreign Affairs and the House Committee on the Judiciary.
