H.R. 2352 — Abolish Super PACs Act

This section states congressional findings that unlimited contributions to super PACs (i.e., political action committees making independent expenditures) increase risks of corruption, appearance of corruption, and foreign interference, citing a more than 700% increase in independent expenditures from 2008 to 2020, $4.48 billion spent in 2024 from 2,459 super PACs, top 1% of individual contributors providing 96.94% of contributions in 2024 (up from 76.76% in 2012), and precedents such as 18 U.S.C. 201 and state prosecutions. It declares the purpose of the Act to impose reasonable contribution limits on super PACs to reduce those risks and restore public faith in elections.

This section amends contribution limits under the Federal Election Campaign Act of 1971 (FECA) to explicitly apply them to independent expenditure committees by inserting such committees into the $5,000 annual limit on contributions by persons to any other political committee (52 U.S.C. 30116(a)(1)(C)). It defines an "independent expenditure committee" as a political committee that makes independent expenditures (i.e., uncoordinated spending expressly advocating for or against a federal candidate) aggregating $5,000 or more during a calendar year, or makes contributions to other such committees aggregating $5,000 or more during a calendar year (including any separate account established for those purposes) (52 U.S.C. 30101(27)). The amendments apply with respect to contributions and independent expenditures made during the first calendar year beginning after enactment and each succeeding calendar year.
