H.R. 2367 — College Employment Accountability Act

This section establishes that no institution of higher education is eligible to receive funds from federal student assistance or federal institutional aid under the Higher Education Act of 1965 if the institution is found to be in violation of section 274A of the Immigration and Nationality Act (8 U.S.C. 1324a). (Section 274A makes it unlawful to hire, recruit, or continue employing unauthorized aliens without complying with employment eligibility verification requirements (i.e., Form I-9).)

This section requires an institution of higher education, as a condition of entering into a program participation agreement to receive federal student aid funds under Title IV of the Higher Education Act of 1965, to participate in the E-Verify Program (i.e., the federal electronic system administered by DHS and SSA to verify the employment eligibility of new hires). (Thus, nonparticipation in E-Verify disqualifies an institution from Title IV eligibility.)

This section requires the Secretary of Homeland Security to monitor every six months whether institutions of higher education are participating in the E-Verify program (i.e., an electronic system to verify employment eligibility of new hires against government records). The section further requires the Secretary to notify the Secretary of Education within 10 days upon finding that an institution of higher education has violated INA §274A (i.e., prohibitions on hiring or continuing to employ unauthorized aliens) or is not participating in E-Verify.
