H.R. 2373 — Increased Accountability for Nonconsensual Pornography Act of 2025

This section amends the civil right of action for nonconsensual disclosure of intimate visual depictions (15 U.S.C. 6851) by (1) revising the definition of consent to require it be "competent" in addition to affirmative, conscious, and voluntary; (2) restructuring the definition of intimate visual depiction to add as a standalone category depictions of an identifiable individual engaging in sexually explicit conduct, separate from depictions of bodily sexual fluids; and (3) increasing statutory damages to $500,000 (from $150,000).
