H.R. 2374 — American Students First Act

This section amends Section 505 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (8 U.S.C. 1623) by (1) revising subsection (b) to limit its exception to subsection (a) only (i.e., the prohibition on states providing postsecondary education benefits, such as in-state tuition, to aliens not lawfully present unless available to all U.S. citizens regardless of residency), and (2) adding subsection (c) to prohibit federal financial assistance to a public institution of higher education (as defined in section 101 of the Higher Education Act of 1965) for the fiscal year following any fiscal year in which the Secretary of Education determines the institution charged such aliens tuition at a rate less than or equal to the in-state resident rate or provided them state-based financial aid.
