H.R. 2377 — National Garden for America’s 250th Anniversary Act

This section directs the Task Force to establish the National Garden of American Heroes, including all related planning, design, construction, permitting, compliance, and land acquisition, notwithstanding restrictions in the Commemorative Works Act (40 U.S.C. §§ 8903(c), 8908(c)) on location and individuals honored. It requires the Task Force to commence construction by July 4, 2026 (to the maximum extent practicable and subject to Secretary of the Interior location approval) or submit a revised timeline if infeasible; authorizes establishment in the White House Reservation or, if on non-federal land, acquisition by the Secretary through purchase, donation, or exchange; and requires solicitation of private contributions. This section establishes the National Garden Fund in the Treasury, consisting of private contributions (plus interest and investment proceeds in U.S. obligations), with amounts available without further appropriation to the Secretary of the Interior (for administrative support), Task Force (for establishment), and National Park Service Director (for maintenance after public opening); authorizes the Director to charge visitation fees if fund balances are insufficient (for maintenance only); and requires Task Force reports to congressional committees every 60 days on establishment progress (until one day before public opening) and Director reports every 60 days thereafter on maintenance.
