H.R. 2385 — CREATE AI Act of 2025

This section states congressional findings that (1) cutting-edge artificial intelligence research relies on access to computational resources and large datasets; (2) such access is limited to large technology companies; (3) this has resulted in insufficient diversity in the artificial intelligence research and development community; (4) engaging diverse U.S. talent is critical for maintaining U.S. leadership in artificial intelligence and ensuring benefits for all Americans; and (5) the National Artificial Intelligence Research Resource Task Force recommended establishing a National Artificial Intelligence Research Resource.

This section amends Section 5103 of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (15 U.S.C. 9413) by redesignating subsection (e) as subsection (f) and inserting a new subsection (e) to establish a National Artificial Intelligence Research Resource (NAIRR) Steering Subcommittee within the Interagency Committee on artificial intelligence. (As background, the NAIRR provides researchers with federated access to shared high-performance computing, datasets, models, and other resources to advance AI research and development.) The OSTP Director chairs the subcommittee—with rotating assistant chairs—and annually reviews its membership, selected from Interagency Committee members with AI expertise or NAIRR ties; the subcommittee may form subcommittees or working groups and perform duties including (1) coordinating with the National Science Foundation (NSF) and NAIRR Program Management Office (PMO) to oversee operating plans and budgets, solicit proposals for and select an operating entity, and issue funding opportunities; (2) identifying and directing allocation of NAIRR resources; (3) defining and annually evaluating key performance indicators, in coordination with the PMO and relevant advisory committees; (4) issuing annual public reports on NAIRR progress with recommendations; and (5) overseeing periodic independent assessments, with member agencies authorized to provide NAIRR resources or funding. This section further amends the National Artificial Intelligence Initiative Act of 2020 (15 U.S.C. 9401 et seq.) by adding new title LVI (secs. 5601-5605) that (1) defines key terms in sec. 5601—including NAIRR, NAIRR Steering Subcommittee, Program Management Office, operating entity, resources of the NAIRR, AI testbed (i.e., as described in 15 U.S.C. 278h-1(g)), advisory committee, executive agency, and STEM; and (2) in sec. 5602, requires the NSF Director, in coordination with the NAIRR Steering Subcommittee, to establish the NAIRR not later than one year after enactment.
