H.R. 2388 — Lower Elwha Klallam Tribe Project Lands Restoration Act

This section takes approximately 1,082.63 acres of federal land in Olympic National Park, as depicted on the map entitled “Olympic National Park Proposed Transfer of Elwha Lands” (numbered 149/178020, dated December 2021), into trust for the benefit of the Lower Elwha Klallam Tribe in Washington and includes the land in the tribe's reservation, subject to valid existing rights. The section (1) exempts the land from federal requirements for valuation, appraisal, or equalization; (2) directs the Secretary of the Interior to survey the land as soon as practicable after enactment and to make minor boundary adjustments or corrections; (3) requires the portion of the Elwha River on the land that is subject to the Elwha River Ecosystem and Fisheries Restoration Act (P.L. 102-495) to be managed in accordance with the policy declaration of the Wild and Scenic Rivers Act (16 U.S.C. 1271)—i.e., preserving selected rivers in free-flowing condition for their outstandingly remarkable scenic, recreational, geologic, fish and wildlife, historic, cultural, or other similar values—with necessary modifications under the Elwha Act; and (4) prohibits the land from being used for gaming under the Indian Gaming Regulatory Act (25 U.S.C. 2701 et seq.).

This section provides that nothing in the Act affects treaty rights under the Treaty of Point No Point between the United States and the S'Klallam Indians, concluded January 26, 1855 (12 Stat. 933).
