H.R. 2389 — Quinault Indian Nation Land Transfer Act

This section directs the administrative transfer of approximately 72 acres of Forest Service land in Washington, generally depicted as “Allotment 1157” on the map entitled “Quinault Indian Nation Land Transfer Act” dated February 2, 2024, to the Department of the Interior to be held in trust for the Quinault Indian Nation, subject to valid existing rights. The land (1) becomes part of the Quinault Indian Reservation; (2) is administered by the Secretary of the Interior pursuant to laws and regulations applicable to federal trust lands for Indian tribes; (3) is ineligible for gaming under the Indian Gaming Regulatory Act (25 U.S.C. 2701 et seq.); and (4) has no effect on rights under the Treaty of Olympia (12 Stat. 971). For the trust transfer, the Secretary must comply with hazardous substance disclosure requirements under CERCLA section 120(h) (42 U.S.C. 9620(h))—which generally requires federal agencies to notify transferees of known hazardous substances, pollutants, or contaminants on conveyed federal real property—but is not required to remediate or abate them.
