H.R. 2409 — Guidance Clarity Act of 2025

This section requires each federal agency to include a specified "guidance clarity statement" prominently on the first page of any guidance document issued without notice-and-comment rulemaking under section 553(b)(4)(A) of the Administrative Procedure Act (APA), beginning 30 days after the Director of the Office of Management and Budget (OMB) issues implementing guidance. The statement declares that the document lacks the force of law, does not bind the public or agency, and only provides clarity on existing legal or policy requirements. OMB must issue such guidance not later than 90 days after enactment.
