H.R. 2445 — Ensuring Medicaid Eligibility Act of 2025

This section prohibits the Secretary of Health and Human Services from implementing, enforcing, or otherwise giving effect to the Medicaid streamlining rule published on April 2, 2024 (89 Fed. Reg. 22780). (The rule streamlines application, eligibility determination, enrollment, and renewal processes for Medicaid, the Children's Health Insurance Program (CHIP), and the Basic Health Program (BHP).)

This section requires state Medicaid plans to (1) prohibit enrollment of any individual prior to verification that the individual is a U.S. citizen or national, or in satisfactory immigration status (as defined in SSA section 1137(d)(1)); and (2) verify eligibility not less frequently than quarterly for individuals whose eligibility is based in part on income (as determined under SSA section 1902(e)(14), the modified adjusted gross income (MAGI) methodology).

This section prohibits federal Medicaid payments to states for medical assistance furnished to an alien granted (1) parole under specified Immigration and Nationality Act provisions, (2) deferred action or deferred enforced departure including DACA, (3) asylum, (4) temporary protected status (TPS), or (5) withholding of removal. (Thus, states receive no federal medical assistance percentage (FMAP) matching funds for such individuals, subject to existing exceptions for emergency services; includes conforming amendment to state plan requirements.)
