H.R. 245 — Grant Integrity and Border Security Act

This section requires the head of each agency to obtain a certification from any applicant for a federal grant (i.e., as defined in 31 U.S.C. 6401) that the applicant has not violated, is not violating, and will not violate during the previous 10 years or the grant term section 274(a) of the Immigration and Nationality Act (8 U.S.C. 1324(a)), which prohibits bringing in and harboring certain aliens. The section further (1) authorizes the relevant agency head to withhold grant funds from any grantee determined to be in violation, based on information from the Secretary of Homeland Security or OMB Director, convictions or admissions by a grantee employee or former employee for violations committed in official duties, or other credible information; and (2) requires the Attorney General to submit related information on convictions, admissions, or completed investigations under INA section 274(a) to the OMB Director within 90 days. It defines "agency" as in 5 U.S.C. 551, "Director" as the OMB Director, and "federal grant" by cross-reference to 31 U.S.C. 6401.
