H.R. 2490 — No In-State Tuition for Illegal Immigrants Act

This section amends Section 505 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (8 U.S.C. 1623) by (1) limiting the scope of subsection (b) to apply only to subsection (a) (from this section), and (2) prohibiting a state from receiving federal financial assistance under title IV of the Higher Education Act of 1965 for the fiscal year following any fiscal year in which the Secretary of Education determines that the state charged an alien not lawfully present tuition at a public institution of higher education at a rate equal to or less than the rate for U.S. citizen residents of the state. (Title IV programs provide federal student aid, including Pell Grants and Direct Loans, to eligible students at participating institutions of higher education.)
