H.R. 2551 — Military Installation Retail Security Act of 2025

This section prohibits the Secretary of Defense from renewing, extending, or entering into a long-term concessions agreement with a retailer controlled by a covered nation (i.e., organized under its laws, 20% or more owned by it, or subject to its control) to operate a physical business location on a U.S. military installation, applicable to agreements entered on or after enactment; authorizes a waiver if goods or services are vital for service member welfare with no alternatives and risks are mitigated, requiring a report to the Armed Services Committees within 30 days; and permits termination for ownership misrepresentation. For covered retailers with pre-enactment agreements, the section (1) requires notice to the Committee on Foreign Investment in the United States (CFIUS) within 30 days disclosing relationships with covered nations, with operations prohibited pending CFIUS investigation and approval determination within 180 days; (2) mandates annual disclosures of ownership changes, with immediate termination for noncompliance; and (3) directs the Secretary to assess all such agreements within 180 days and terminate those with control by a covered nation. (Thus, these requirements apply to nonappropriated fund instrumentalities and other retailers operating concessions—e.g., exchanges, commissaries—for service member morale and recreation on U.S. bases.)
