H.R. 2586 — Reentry Act of 2025

This section amends the Medicaid definition of medical assistance in section 1905(a) of the Social Security Act to allow coverage of care and services provided to individuals during the 30-day period preceding their release from a public institution. (Thus, this permits states to provide Medicaid services to eligible inmates prior to release, creating an exception to the general prohibition on federal Medicaid funding for inmates of public institutions.) The section also requires the Medicaid and CHIP Payment and Access Commission (MACPAC) to submit a report to Congress not later than 18 months after enactment analyzing the Medicaid inmate exclusion, including to the extent practicable: (1) standards for health care in correctional facilities, access to medical and behavioral health services, applicability of Medicare/Medicaid conditions of participation and state licensing standards, and comparisons to community accrediting bodies; and (2) impacts of this amendment, such as the number of eligible incarcerated individuals, effects on coverage and community reentry, discharge practices with state Medicaid agencies, and recommendations for legislative or administrative actions to improve health coverage transitions and addiction treatment for those released from incarceration.
