H.R. 2633 — U.S.-South Africa Bilateral Relations Review Act of 2025

This section sets forth congressional findings that factions within South Africa's African National Congress (ANC) have acted inconsistently with the government's nonalignment policy, including by supporting Hamas—a U.S.-designated foreign terrorist organization—since 1994 and following its October 7, 2023, attack on Israel; pursuing closer ties with China and Russia; hosting Hamas officials and Iranian leaders; filing genocide accusations against Israel at the International Court of Justice; facilitating sanctioned Russian military activities; and maintaining other specified relations with malign actors.

This section states the sense of Congress that (1) the United States has a national security interest in deterring strategic political and security cooperation and information sharing with the People's Republic of China (PRC) and the Russian Federation, particularly cooperation that aids Russia's war of aggression against Ukraine or enhances Russia's international standing or influence; and (2) the South African government's foreign policy actions no longer reflect its stated nonalignment and instead favor the PRC, the Russian Federation, and Hamas—a proxy of Iran—thereby undermining U.S. national security and foreign policy interests.

This section directs the President, in consultation with the Secretary of State and the Secretary of Defense, to certify to the appropriate congressional committees and publicly release, not later than 30 days after enactment, an unclassified determination stating whether South Africa has engaged in activities that undermine U.S. national security or foreign policy interests. The certification must be accompanied by an unclassified report to the committees—with a classified annex if necessary—providing the justification for the determination.

This section directs the President, in consultation with the Secretary of State, Secretary of Defense, United States Trade Representative, and heads of other relevant federal departments and agencies, to conduct a comprehensive review of the U.S.-South Africa bilateral relationship and submit a report on the findings to the appropriate congressional committees not later than 120 days after enactment.

This section requires the President, in consultation with the Secretary of State and Secretary of the Treasury, to submit to the appropriate congressional committees, not later than 120 days after enactment, a classified report listing senior South African government officials and African National Congress (ANC) leaders determined—based on credible evidence—to have engaged in corruption or human rights abuses meeting the criteria for sanctions under the Global Magnitsky Human Rights Accountability Act (i.e., a law authorizing asset blocking and visa bans against foreign persons for gross human rights violations or significant corruption). For each listed person, the report must provide (1) a detailed explanation of the conduct and (2) either an expected timeline for imposing sanctions or a detailed justification, including rationale and legal authorities, for not imposing them.

This section establishes definitions for terms used in the bill, including ANC (African National Congress), appropriate congressional committees (Committee on Foreign Affairs of the House of Representatives and Committee on Foreign Relations of the Senate), CCP (Chinese Communist Party), and PRC (People’s Republic of China).
