H.R. 2643 — Haiti Criminal Collusion Transparency Act of 2025

This section requires the Secretary of State, in coordination with other federal agencies as appropriate, to submit to the appropriate congressional committees a report on ties between criminal gangs and political and economic elites in Haiti not later than 180 days after enactment of this Act and annually thereafter for five years. The report must (1) identify prominent criminal gangs in Haiti, their leaders, criminal activities (including coercive recruitment), and primary geographic areas of operation; (2) list Haitian political and economic elites with direct links to those gangs or organizations or entities they control; (3) describe those relationships in detail; (4) describe in detail how those elites use the gangs to advance their political and economic interests; (5) list criminal organizations assessed to be trafficking Haitians and others to the U.S. border; (6) assess ties between those elites, gangs, and transnational criminal organizations; (7) assess how such collusion threatens the Haitian people and U.S. national interests and activities in Haiti; and (8) assess potential U.S. government actions to address the findings under (6). The report must be submitted in unclassified form but may include a classified annex.

This section requires the President, not later than 90 days after submitting the report required under section 2, to impose sanctions on each foreign person identified pursuant to sections 2(a)(1) and 2(a)(2). The sanctions are (1) blocking all property and interests in property of such persons that are in the United States, come within the United States, or are or come within the possession or control of a U.S. person—authorized notwithstanding the national emergency declaration requirement of section 202(a) of the International Emergency Economic Powers Act (IEEPA, 50 U.S.C. 1701(a)) (thus, enabling asset freezes without invoking IEEPA's standard emergency procedures for foreign threats); and (2) rendering such persons inadmissible to the United States, ineligible for visas or parole, and subject to visa revocation under the Immigration and Nationality Act (8 U.S.C. 1101 et seq.). The section provides exceptions for admissions necessary to comply with U.S. international obligations (e.g., UN Headquarters Agreement), transactions involving humanitarian assistance to Haiti (including agricultural commodities, food, medicine, medical devices, and related financial or transport activities), and the importation of goods; authorizes the President to implement sanctions using IEEPA authorities (50 U.S.C. 1702, 1704) with corresponding civil and criminal penalties (50 U.S.C. 1705); and permits waivers if vital to U.S. national interests.

This section defines terms used in the Act, including "appropriate congressional committees" (i.e., specified committees of the House and Senate on foreign affairs, financial services, banking, intelligence, and appropriations); "foreign person" (i.e., an individual or entity that is not a United States person); "United States person" (i.e., a U.S. citizen, permanent resident alien, or entity organized under U.S. laws or any U.S. jurisdiction, including its foreign branches); "economic elites" (i.e., board members, officers, and executives of groups, committees, corporations, or other entities exerting substantial influence or control over Haiti's economy, infrastructure, or particular industries); and "political elites" (i.e., current and former government officials and their high-level staff, political party leaders, and political committee leaders).
