This section amends Title III of the Help America Vote Act of 2002 (52 U.S.C. 21081 et seq.) to establish deadlines for states in elections for federal office: (1) count at least 90% of ballots within 72 hours after polls close and publicly report the results; and (2) complete counting of all ballots, officially certify results, and publicly report within two weeks after polls close. A state is not out of compliance if the Election Assistance Commission and Attorney General certify the failure resulted from (1) a bona fide emergency, including a major disaster as defined in the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5122), a public health emergency, or a cyberattack or other security threat to election infrastructure; (2) technical difficulties such as malfunctioning equipment or tabulation errors; (3) implementation of new election procedures in the first election following such changes; or (4) a recount. States certified as noncompliant are ineligible for Election Assistance Commission funds for subsequent election administration unless they submit a compliance plan certified by the Commission and Attorney General. Makes conforming amendments to existing enforcement provisions and the table of contents and applies to elections occurring after the 90-day period beginning on the date of enactment.
