H.R. 2710 — People Over Parking Act of 2025

This section grants owners sole discretion to determine the number of automobile parking spots for newly constructed or substantially reconstructed or rehabilitated residential, retail, commercial, or industrial structures—or permitted projects for such—located not more than 0.5 miles from the closest covered public transit point. It preempts any inconsistent state or local law, regulation, or requirement to the extent of the inconsistency. A covered public transit point is a passenger access point to a fixed guideway public transportation system (i.e., rail transit, bus rapid transit, or ferryboat service, as defined in 49 U.S.C. 5302), except that for passenger ferry systems the point must also be serviced by another public transportation mode and for non-bus rapid transit bus systems it must intersect two or more bus routes with service intervals of not more than 15 minutes during morning and afternoon peak commuting periods.
