H.R. 2713 — MAIN Event Ticketing Act

This section expands prohibitions under the Better Online Ticket Sales Act of 2016 (BOTS Act)—which bars circumventing a ticket issuer's technological measures to enforce event ticket purchase limits—to also bar using or causing to be used any automated application to purchase such tickets in violation of the issuer's posted rules. The section further establishes requirements for ticket issuers operating online ticket sales platforms, as follows: (1) ensure access control systems or equivalent measures enforce posted purchase limits; (2) implement and maintain reasonable administrative, technical, and physical safeguards to protect site security (considering issuer size, activities, customer data sensitivity, and risks), including oversight of third-party service providers and periodic updates for evolving threats; (3) report known circumvention incidents to the Federal Trade Commission (FTC) within 30 days (with the FTC required to establish a consumer complaint website within 180 days of enactment and share reports and complaints with state attorneys general); and (4) take reasonable steps to improve controls following known incidents. Additionally, the section directs the FTC to issue compliance guidance for ticket issuers within one year of enactment. (Thus, these measures aim to combat bot-driven ticket scalping by imposing affirmative duties on sellers previously focused only on buyer conduct.)
