H.R. 2715 — Destruction of Hazardous Imports Act

This section amends section 801(a) of the Federal Food, Drug, and Cosmetic Act (FD&C Act) to authorize the Secretary of Health and Human Services to destroy any article refused admission under that section if determined to present a significant public health concern (in addition to those described under subsection (b)); replaces references to "drug or device" with "drug, device, or other article" in subsequent sentences; and adds a new prohibited act under section 301(jjj) prohibiting the unauthorized movement or introduction (including export) into interstate commerce of any such article selected for destruction. (As background, section 801(a) governs FDA refusal of adulterated, misbranded, or otherwise violative imports, which are typically re-exported unless destroyed under limited prior conditions.) The amendments apply beginning 180 days after enactment, and the Secretary, acting through the FDA Commissioner, must finalize implementing regulations within 90 days of enactment, consistent with international agreements.
