H.R. 2716 — Ending Improper Payments to Deceased People Act

This section amends SSA death information-sharing requirements (42 U.S.C. 405(r)) to improve coordination with the Do Not Pay working system (i.e., a federal system under 31 U.S.C. 3354(c) to prevent and recover improper payments across federal programs). Specifically, it (1) replaces paragraph (11) to require the Commissioner of Social Security, to the extent feasible, to share such information with the Do Not Pay agency via cooperative arrangement (meeting existing data protections) that includes a periodically reviewed agreement on proportional state death data costs; (2) adds paragraph (12) prohibiting the Commissioner from recording a death on a shareable record without clear and convincing evidence presuming the individual deceased; and (3) amends paragraph (7) to require notifying agencies with cooperative arrangements under paragraphs (3) or (11) of errors incorrectly identifying individuals as deceased. The amendments take effect on December 27, 2026.
