H.R. 2732 — Fairness for Stay-at-Home Parents Act

This section amends the Family and Medical Leave Act of 1993 (FMLA) provision on employer recovery of health insurance premiums paid to maintain coverage during unpaid FMLA leave (1) by adding the birth of a son or daughter to the list of circumstances beyond the employee's control—such as the continuation of a serious health condition or other unavoidable factors—that prohibit recovery if the employee fails to return to work; and (2) by requiring employers to notify eligible employees taking FMLA leave for a birth that the employer may not recover such premiums if the employee fails to return due to the birth. (Thus, parents electing extended leave post-birth are protected from premium repayment.)
