H.R. 2754 — Protecting Military Installations and Ranges Act of 2025

This section expands the definition of covered transaction under the Committee on Foreign Investment in the United States (CFIUS)—which reviews foreign investments, including certain real estate purchases or leases, for national security risks—to include the purchase, lease, or concession by a foreign person of U.S. real estate located within (1) 100 miles of a military installation or (2) 50 miles of a military training route, Department of Defense-managed special use airspace, controlled firing area used by the Department of Defense, or military operations area, if the foreign person is owned or controlled by, acts on behalf of, or receives subsidies from the governments of Russia, China, Iran, or North Korea (notwithstanding existing limitations on real estate jurisdiction). (Thus, such transactions proposed, pending, or completed on or after enactment are subject to CFIUS review.) The section further requires CFIUS to unilaterally initiate reviews of these transactions and directs CFIUS to provide certifications to the Senators from the relevant state and the Representative from the relevant congressional district concerning any such reviewed transactions.

This section establishes special rules limiting Department of Defense (DoD) and Department of Transportation review and approval of energy projects under the Military Aviation and Installation Assurance Siting Clearinghouse (established under 10 U.S.C. §183a to coordinate DoD assessment of energy projects and antenna structures that may affect military aviation, installations, and readiness) when the underlying real property purchase, lease, or concession is under review by the Committee on Foreign Investment in the United States (CFIUS). Specifically, it— (1) prohibits DoD from completing its review until CFIUS concludes and requires DoD to find the project poses an unacceptable national security risk (under 10 U.S.C. §183a(e)(1))—transmitting that finding to the Secretary of Transportation—if CFIUS refers the transaction to the President; and (2) prohibits the Secretary of Transportation from issuing a determination until CFIUS concludes and DoD issues a finding under §183a(e) or advises no finding is forthcoming.
